User Conduct

All AppleMagazine digital channels and its contents, including but not limited to articles, newsletters, graphical images, interactive applications, social media content, comments, broadcasting content, including audio and video material, compilations of material, and the user interface (the “Content”) are the property and copyrighted material of AppleMagazine, its licensors, authorized sellers, distributors, and vendors. “Content” also includes any material from the application, website, or any link that AppleMagazine delivers to you through e-mail or social media. You may display the Content and otherwise use the digital channel solely for your personal, noncommercial use. You may not modify, copy, distribute, forward, display, repost, reprint, sublicense or create derivative works from, transfer, link to, quote, or sell any content except as expressly permitted by the copyright laws, in this Agreement, or in the Permission Services section.

All trademarks used on digital channels are the property of their respective owners. The trademarks may be used only with the express permission of AppleMagazine.

User Participation

You may post material to message boards, forums, and other interactive areas of the digital channels. However, you may not post any material that (1) is defamatory, libelous, obscene, indecent, abusive, or threatening to others; (2) infringes the copyright, trademark, or other rights of any third party; (3) uploads viruses or other contaminating or destructive features; (4) is commercial in nature; or (5) is in violation of any applicable laws or regulations. You are solely responsible for ensuring that any material you post complies with the foregoing conditions and will indemnify AppleMagazine, its officers, and employees from and against all claims, liabilities, judgments, damages, and costs (including attorney’s fees) which arise out of materials you have posted on the digital channels. If AppleMagazine becomes aware of any material that it believes may violate the foregoing conditions, it may, at its sole discretion, modify or remove the material.

You grant to AppleMagazine the right to copy, publish, distribute, modify, translate, and otherwise use in any medium, any material that you place on the digital channels by any means, without compensation.

Purchase of Services

You may have the opportunity to order or receive services through the digital channels directly or through links. All Services (unless otherwise noted as owned or offered by AppleMagazine) are provided by third-party vendors (“Vendors”) pursuant to agreements, licenses, or other arrangements between that Vendor and you.

All aspects of your transactions regarding the Services, including, but not limited to, single edition, subscription, broadcast, purchase terms, payment terms, warranties, guarantees, maintenance, and delivery, are solely between you and the applicable Vendor, including but not limited to Apple App Store™, Zinio™, and others. Your rights and remedies with respect to such transactions shall be solely against the applicable Vendor and any questions, complaints, or claims related to any Service should be directed to that Vendor. Any communication received in our support channels will be redirected to the Vendor, if identified.

By using the digital channel you acknowledge and agree that AppleMagazine and its affiliates shall have no liability for any cost, damage, or harm arising directly or indirectly in connection with any of the Services ordered or received through these digital channels or through links or from any action or inaction of any Vendor.

Copyright, Arbitration, and Dispute Resolution

By navigating our website, including this domain, its subdomains, breaking news content, app, digital magazine, or any other related channels, or by directly or indirectly accessing digital content provided by this platform, you expressly and unequivocally agree to the following terms:

1. Content Usage and Copyright Notice

AppleMagazine declares that all content published across its channels is sourced exclusively from free-to-access content available on the Internet or provided by free-library platforms, agencies, and authors. AppleMagazine adheres to an internal policy of searching for and referencing any copyright restrictions, usage limitations, or authorship rights in good faith by:

  1. Providing proper credit in a visible manner,
  2. Applying missing metadata for credits or authorship when available.

All content published is curated with the intent to provide reliable information to our readers and visitors in good faith.

AppleMagazine asserts that no restricted content protected by paywalls or other access restrictions is used arbitrarily by our content production team, associates, publishing partners, or agencies.

2. Copyright Infringement Claims

Considering the Internet as a vast source of indexed content with varying degrees of authorship identification and copyright restrictions, AppleMagazine sets forth the following procedure for addressing copyright infringement claims related to any protected content published on its platform:

  1. Notification: Submit a notification containing the following information related to the alleged infringement:
    • Domain, link, sub-link, and placement of the content,
    • Date of publication,
    • Authorship and copyright authority identification number, including the country or countries of registration,
    • Terms of use, legal representation information, original source of the alleged restricted content, original date of publication, and any other relevant information for identification and verification of the claim.
  2. Mitigation: AppleMagazine will take action to address the claim by either:
    • Removing the alleged infringing content within a reasonable time after receiving the notification, or
    • Attributing proper authorship to the content if requested by the author.
  3. Content Removal: If the claim is substantiated by evidence showing that:
    • The content is access-restricted and not freely accessible via search engines,
    • The content is available only through access-restricted sources,
    • The content includes copyright registration in its digital-file metadata,
    • The content is identified as restricted for editorial use, or
    • The content is not publicly available for direct access, use, copy, download, file saving, or reproduction,

    AppleMagazine will delete the alleged infringing content from all media libraries within a reasonable time.

  4. Arbitration Requirement: The original author, their legal representative, and any other involved parties must acknowledge the good-faith nature of the publication and agree to resolve the matter through individual arbitration, foregoing lawsuit actions or allegations of bad faith in pursuit of financial compensation for alleged damages.

3. Arbitration Clause

Any disputes, including but not limited to claims of copyright infringement, use restrictions (editorial, commercial, technical, etc.), or any other related issues, if proven, MUST BE RESOLVED EXCLUSIVELY THROUGH INDIVIDUAL ARBITRATION. No lawsuits or legal claims shall be pursued once the alleged infringing content has been removed from the platform.

4. Immediate Content Removal

AppleMagazine reserves the right to take immediate action to withdraw any content, image, video, illustration, or any type of media, including but not limited to illustrations, photography, citations, information, rumors, financial statements, news, promotions, prices, brand references, or promotional content, that has been published in whole or in part.

5. Finality of Action

No further legal action or lawsuit shall be initiated once the alleged infringing content has been removed from the platform.

Intellectual Property Infringement Claims

It is the policy of AppleMagazine to respond expeditiously to claims of intellectual property infringement. AppleMagazine will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright © and other applicable intellectual property laws. Upon receipt of notices complying or substantially complying with the Digital Millennium Copyright © Act, AppleMagazine will act expeditiously to remove or disable access to any material claimed to be infringing or claimed to be the subject of infringing activity and will act expeditiously to remove or disable access to any reference or link to material or activity that is claimed to be infringing. AppleMagazine will terminate access for subscribers and account holders who are repeat infringers.

ANY INFORMATION, PRODUCT, OR SERVICE PROVIDED THROUGH DIGITAL CHANNELS IS PROVIDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, AND ALL EXPRESS OR IMPLIED WARRANTIES ARE HEREBY EXCLUDED, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

APPLEMAGAZINE MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE TRUTH, ACCURACY, OR COMPLETENESS OF ANY STATEMENTS, INFORMATION, OR MATERIAL CONTAINED ON THE DIGITAL CHANNEL.

APPLEMAGAZINE WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES RESULTING FROM LOST PROFITS OR REVENUE; LOSS OF USE OF DIGITAL CHANNELS OR ANY EXECUTABLE SOFTWARE; DELAYS IN OPERATION OR TRANSMISSION, COMMUNICATIONS LINE FAILURE, UNDELIVERED E-MAIL MESSAGES, LOSS OF USE OF DATA OR EQUIPMENT; OR OTHER SIMILAR DAMAGES) ARISING OUT OF THE USE OR INABILITY TO USE THE CONTENT, PRODUCTS OR SERVICES, EVEN IF APPLEMAGAZINE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You understand that user-posted material expresses the views of that user and not the view of AppleMagazine.

The digital channels may contain links to other’s websites, apps, or social media accounts, that are owned and operated by third parties. You acknowledge that AppleMagazine is not responsible for the accuracy, content, or availability of information accessed or linked to through the digital channels, nor does the inclusion of any such link imply endorsement by AppleMagazine of that content.

General

AppleMagazine reserves the right to change this Agreement at any time by revising the terms and conditions herein. You are responsible for regularly reviewing these terms and conditions and your use of the digital channels following any such change constitutes your acceptance of such changes.

AppleMagazine reserves the right to change the digital channels at any time at its sole discretion without notice to users. AppleMagazine may deny access to any digital channel to anyone at any time.

This Agreement shall include any additional terms, conditions, notices, policies, or disclaimers provided by AppleMagazine, its licensors, or vendors in specific areas, regions, countries, or geographically determined limitations. However, in the event of a conflict between such terms and this Agreement, the terms of this Agreement shall control.

The foregoing notwithstanding, nothing in this Agreement will be deemed to preclude any party from using the legal process of any court with jurisdiction to seek remedy or redress (including without limitation injunctive or other equitable relief) for any infringement of copyright, trademark rights, or other intellectual property rights.
